Аннотация:https://doi.org/10.24031/2226-0781-2023-13-1-203-235Применение цифровых технологий в сфере правосудия получает все более и более широкое распространение в различных государствах. Передовым опытом в создании онлайн судов с применением искусственного интеллекта и больших данных обладает Китайская Народная Республика. Анализ применения различных инструментов в правосудии, предложения разработчиков в России и за рубежом через призму китайского опыта позволяют установить, что внедрение технологий приводит к необходимости переосмысления основных начал правосудия.Информационные технологии обладают более убедительной и, по-видимому, более объективной нормативностью, чем та, которая заложена в формальных правилах судопроизводства. Авторами установлено, что применение технологий позволяет алгоритмизировать процесс осуществления судебной власти таким образом, чтобы максимально соблюсти основные стандарты правосудия. Трансформация судопроизводства за счет технологий может получить свое закрепление как путем создания специальных норм материального и процессуального права,так и путем выработки стандартов и правил для разработчиков и пользователей технологических решений, непосредственно влияющих на характер и содержание общественных отношений в рамках судебного процесса. The People’s Republic of China has advanced experience in creating online courts using artificial intelligence and big data. The analysis of application of various tools in justice, proposals of developers in Russia and abroad through the prism of Chinese experience allows to establish that introduction of technologies leads to necessity of rethinking of basic principles of justice. Information technologies possess more convincing and, apparently, more objective normativity, than that which is inherent in formal rules of legal proceedings. The authors found that the use of technology allows us to algorithmize the process of exercising judicial power in such a way as to maximize compliance with the basic standards of justice.Transformation of judicial proceedings due to technology can be fixed both by creating special norms of substantive and procedural law, and by developing standards and rules for the developers and users of technological solutions, directly affecting the nature and content of social relations within the judicial process.
